 As 468 famílias que vivem há três anos no número 911 da avenida Prestes Maia podem ser despejadas. O prédio é a última grande ocupação a resistir à política higienista do prefeito José Serra e ao projeto de "revitalização" - expulsão dos pobres - do centro de São Paulo. Entre os dias 15 e 21 de fevereiro, o 7º Batalhão de Choque da Polícia Militar de SP pode colocar na rua as 1.630 pessoas que vivem no local. Elas transformaram o que era depósito de lixo e ponto de tráfico de drogas em moradia, que inclui uma biblioteca com mais de 3.500 livros. O imóvel é de propriedade do vereador Jorge Hamuche e de Eduardo Amorim. Além de não possuírem a escritura, os dois deixaram o edifício abandonado por 12 anos e devem R$ 5 milhões em IPTU ao governo municipal. O direito à moradia ganhou o status de direito fundamental, na qualidade de direito social, na Cosntituição Federal de 1988. Isto significa um déficit entre o que prevê a Lei e a realidade brasileira, não apenas em São Paulo, ou nas grandes metrópoles, embora nestas mais acentuado. No entanto, o direito de propriedade também é um direito fundamental, embora toda a propriedade deva cumprir um papel social. O que em Direito chamamos Função Social da Propriedade. Inegável que quem ocupa um imóvel não mpretende sair do mesmo, mas da mesma forma, o seu dono, real propreitário, não quer perdê-lo. Daí o embate jurídico.
